Police tasered diabetic in a coma - because they thought he was a suicide bomber
15th November 2007

A man who slipped into a diabetic coma on the top deck of a bus has described how he was used for electric stun gun "target practice" after police mistook him for a suicide bomber.

Innocent Nicolas Gaubert was shot twice with a Taser gun in what he said was a chilling precursor to the death of Jean Charles de Menezes in London just over a week later.

Mr Gaubert was on his way home from work in Leeds city centre, West Yorks, when he suffered a hypoglycaemic fit and was found slumped in his seat by the bus driver at the end of the route in Headingley, Leeds.

Police were called and two officers, who had been issued with Tasers just a fortnight earlier, boarded the empty bus and used the weapon twice on Mr Gaubert after he failed to respond to instructions.

Officers finally took him to Leeds General Infirmary, but the 34-year-old claims they refused to remove his handcuffs despite being told by a nurse that he was suffering the effects of diabetes.

Mr Gaubert, who is now considering legal action, said he had remained silent until now but had decided to speak out after the Crown Prosecution Service confirmed that no charges would be brought over the incident on July 13, 2005.

The complaint has now been passed to the Independent Police Complaints Commission (IPCC).

Mr Gaubert said: "I am absolutely disgusted that no action will be taken. I was totally innocent. The only thing that could have made people suspicious was that I had a black rucksack with me.

"But I am a white male, and if I was planning to blow up the bus, why didn't I do it when there were passengers on board?

"I have been told that I am the first person to be Tasered in West Yorkshire.

"Senior officers also told me after the incident that the policeman who came on the bus had been told not to use weapons on me if I did not respond. But they did.

"I think the officers involved just saw it was an opportunity to try out their new toys. It should have been obvious that I was having a hypo and I wear a necklace alerting people I am diabetic.

Mr Gaubert, who runs his own business and lives in Leeds, said he was now forced to take medication and his life "had completely changed" as a result of his ordeal.

He said West Yorkshire Police told him that he had been blasted twice with the weapons because after the first shock he had fallen from his seat and lay face down with one hand underneath his body.

Officers said when he failed to respond to requests to remove his hand, they felt they had to stun him again to ensure it was safe to approach.

Mr Gaubert, whose mother is a magistrate in Rotherham and both his parents are retired GPs, is now being advised by Sheffield law firm Irwin Mitchell.

He said: "I was going to stay quiet, but if this passes without being highlighted then it could happen to someone else. People think the police are always on their side but I was easy target practice.

"I couldn't let them get away with it. I broke down when the de Menezes case was reported recently. I just kept thinking that could have been me."

One of the two officers, who has not been named has been transferred to South Yorkshire Police.

Both South Yorkshire and West Yorkshire Police said they are "in discussions" with the IPCC.

An IPCC spokesman said: "The IPCC managed an investigation into an incident on July 13, 2005 in which West Yorkshire Police discharged a Taser at a man while he sat on a bus in Leeds.

"The man was mistakenly treated as a potential security threat when he was, in fact, in a hypoglycaemic state. The investigation report was submitted to the Crown Prosecution Service in November 2006.

"The CPS returned its initial decision in February 2007 stating that no officers should be charged with any criminal offences. Consideration was then given by the CPS as to whether any offences had been committed under health and safety law.

"A decision was received recently to advise that no charges would be brought under the legislation.

"The IPCC must determine whether any disciplinary matters need to be considered against the officers involved. Initial recommendations regarding discipline put forward by the police forces involved have not been agreed by the IPCC and discussions are ongoing."

Simply unbelievable.

As the victim himself is quoted as saying, thank god he didn't come out of the coma, disoriented, and lashed out at people standing over him.

Plus if they were really that concerned, do they not use the Kratos method in West Yorkshire?

Me thinks the "Ways and means Act" was in operation.

Not surprising CPS did nothing as I believe 48% of them are Freemasons (according to a guy protesting in London). Protecting their fellow freemason organization.

it seems the article has been pulled maybe? it was working fine when i first posted it as i always check.

i reckon merge comments about the story in with the other thread, and bin my posts here and any unrelated post, for the purpose of keeping it all together(up to mods of course just giving my consent on binning me without fear of being labelled as censorship).

my original post is pointless if the link is'nt working therefore useless.

Every police officer could soon be armed with a stun gun.

Jacqui Smith, the Home Secretary, said it was "pretty clear" that the weapons were more effective for subduing suspects and caused less harm than traditional batons.

Issuing the 50,000-volt electric stun guns to all officers would be a "sensible provision" provided they were properly trained in how to use them, she added.

The weapons, previously used only by specialist firearms officers, have recently been issued to trained regular officers in pilot schemes.

Human rights campaigners argue that they are too dangerous to be issued routinely.

Mrs Smith told Police Review magazine that she "could see a day" when all officers were armed with stun guns. "If police officers could be prevented from injury because they are able to subdue someone more quickly than with other methods, then it would be viable," she said.

"I have talked to some of the police officers I work most closely with and it is pretty clear from what they tell me that even using a baton on someone is likely to be less effective and wreak more damage on the person receiving it. There is a logic here. If we can find a way through it that provides the appropriate training, and if we can be confident, as we have been, about the medical impact… it seems to me like a sensible sort of provision."

The Police Federation, which represents rank-and-file officers in England and Wales, has called for all officers to be equipped with stun guns. However, in the United States, where they are used widely, more than 150 people have died after being shocked with the weapons. Most of the deaths were put down to factors such as drug use or heart conditions.

Taser International, one maker of the devices, has successfully defended more than 50 legal claims of wrongful death or injury.

Kate Allen, director of Amnesty International UK, said that because stun guns could kill, "they must be treated as lethal weapons. We want an assurance from the Home Office and police chiefs that these weapons will only be issued to trained firearms officers and kept locked in the firearms box."

incidently i witnessed excessive use of force by our police officers in london and when i questioned it.. well you can guess what happened.. I have a complaint logged with the IPCC and have requested any info via freedom of info act. Ive written a statement which i'll post up when i get any CCTV (if they release it)

So yeah.. if they had tasers i guess i would have had 50k volts in me, because apparently thats ok

We will end up like America. These weapons will be used for compliance on anyone, guilty of a crime or not because the Police suspect you to be a thug or criminal first, you presumed guilty before being proven innocent.. You could think that we can trust our officers but stop and think about the type of people who become police officers nowadays. School ground bullies, people with superiority complexes, ex military, thugs who need a career etc. The police entrance exam is easier than a GCSE, apparently.

Less than 1% of people are true criminals. Violent or thieves.. There really is no need for teasers to be rolled out apart from for greater control over the public. It would be more logical to regulate and allow good citizens to be able to carry their own tasers or pepper spray so they are empowered to defend themselves and others. Remember the Police are generally not there while a crime is being carried out, they arrive after.

From Cur Ian Blair, Jack Straw and Bernie Kerik on down, from BAE to the 'Guatanamos' euphemistically called immigration detention centres, the police are now firmly on the side of, and/or aiding and abetting criminality.

There would seem to be a direct correlation between the state of police funding and the level of police state. Perhaps we should take a leaf out of the After School Arms Club book and all equip ourselves with tasers and/or taser-proof clothing, to defend our human rights against this rising hoard of government-sanctioned thugs and bullies?

Taser proof clothing, where do I get some. That would be hilarious them 'zapping' you and you just laughing at them. It isn't kevlar is it as that could prove expensive? Maybe there's a market there, I'd buy one that's for sure!

Well they had better think again. Oh and what was that story about the guy who was in a diabetic coma on a bus and got tasered because he couldnt respond to the police demands (as if you can in the middle of an coma)

Seems the taser is innocent after all;

A post-mortem examination found that Mr Petty died from an incision wound to the neck and stab wounds, said police.

A force spokeswoman said: "The pathologist also found that the taser which police used in dealing with the incident was not a contributory factor in his death."

Whether or not the death in this case was caused by the taser doesn't make much difference. We know how many deaths there have been in the US from them.

It makes a huge difference given the way the thread was headed. This seems to escape you. There was no question raised by it - The Gestapo killed with a taser - end of story.

I saw the follow up piece a week ago and waited for someone to do the right thing and add the conclusion to the story. Instead, it damages the while impetus of the piece if we admit we were wrong - so it goes uncorrected. Even the mainstream media avoided highlighting the whole story. Here we are promoting truth, yet we load the information before establishing the true facts, which then are proven wrong.

This is not balanced evaluative publication of data, it is as biased and untrustworthy as the BBC's coverage of WTC7.

I'm not really bothered about this thread or it's title so yes I guess whatever it is you're on about does escape me.

Thought you might have realised I wasn't refering to this thread or it's title by the way I said 'Whether or not the death in this case was caused by the taser doesn't make much difference' and then went on to actually make the point concerning actual deaths from tasers.

looking at America as the example we seem to be following, they are now employing acoustic, sonic and microwave weapons on the streets.. All non lethal so its ok right? I dont think so. We must take a stand here..
