Seems a strange mixture of items to have on a barristers pen drive? All local issues PLUS the London Bomb intel and terror training in Pakistan. This surveillance intel could have been useful.

A woman was stunned to discover a computer memory stick belonging to a lawyer lying on the pavement in Hope Street, Liverpool.

She said the electronic device contained extensive information about the killing of the 11-year-old in Croxteth – including names and addresses of witnesses, many of whose identities were kept anonymous to the public during the two-month trial.

Merseyside Police today insisted that there was nothing of a sensitive nature contained on the memory stick.

However the woman said she was also able to see information about:

Victims in high-profile cases, including some graphic accounts of sexual abuse cases.

People’s private bank account details and claims made by patients against various NHS trusts, including Liverpool Women’s Hospital.

Files of surveillance of Islamic terror suspects from the London bombings in 2005 and information about terror training in Pakistan.

Details of the Liam Smith murder outside Altcourse Prison in Fazakerley and the fatal stabbing of mother Rachel Jones in Everton.

Intelligence about police tactics from Operation Alarm – a major criminal investigation – and Operation Gingerbread.

Today, the Toxteth woman who found the memory stick said she was horrified such important data could easily have ended up in the wrong hands.

The mother, in her late 20s, contacted Merseyside Police who arranged for an officer to pick up the vital computer component.

She said: “I plugged the stick into my own computer as I thought it might contain university work and I could give it back to them.

“If that information had been seen by a career criminal, I dread to think what could have happened.

“The text should be encrypted in some way so if it’s lost or is seen by someone who it’s not intended for, they can’t read it.”


The memory stick was found after the barrister’s car was broken into and a number of items stolen.

The lawyer, whose name the ECHO has decided to withhold, declined to comment.

A Merseyside Police spokeswoman said: “We can confirm we are investigating the theft of a laptop and pen drive belonging to a barrister, on Friday, 2nd January.

“The Crown Prosecution Service has advised that information relating to the Rhys Jones murder investigation was contained on the pen drive, but only that which was revealed publicly in open court.

“The information was not of a sensitive nature, does not compromise the investigation, trial or any future court proceedings. No personal information relating to any witnesses involved in the case was included in the data.

“The pen drive was recovered on the same date as it was stolen and the laptop is encrypted and cannot be accessed.”

Although the barrister is not named i suspect it could be a Neil Flewitt QC whose names are linked with the Rhys Jones case and also the bombings

Whilst trying to avoid the "thieving" stereotype of my nearest city I see that thieving info from Barristers (as it contains bank account details) also happens in the capitol. Perhaps targeted for more sinister motives. Sadly in Liverpool or anywhere a laptop left in a car is not the wisest thing to do.

The barristers’ profession is the latest victim of the theft of personal data after a laptop and four computer hard-drives were stolen from the London offices of the Bar Council.

The stolen hardware contained records of all practising barristers including thousands of personal bank account details.

It also included the details of 1500 complaints lodged about barristers with the complainants’ names and addresses and details of witnesses and the barristers involved.

The break-in took place last Friday at the Holborn offices of the Bar Council, which also houses its regulatory arm, the Bar Standards Board.

The theft was discovered on Saturday morning and police were on the scene on the same day. An investigation is underway.

The Bar Council confirmed the loss yesterday. In a statement, it said that all the stolen data was held under two or three levels of security.

“The data is covered by a high level of protection and cannot be accessed readily," it said. “As an approved regulator, and a responsible authority for data, the Bar Council takes its data protection responsibilities seriously, and has adopted a precautionary approach.”

The protected data stolen is:

* the contact details and basic factual data records of all practising barristers and some non-practising barristers. Much of this data is routinely publicised in Bar directories and on Chambers websites.

* the protected records (name, bank account number and sort code) of 3,000 Direct Debit payers; it does not include any passwords, debit or credit card numbers, or pin numbers

* the protected contact addresses of lay members of Bar Council and Bar Standards Board committees

* approximately 1500 protected original complaints records being used for new IT system testing, which includes names and contact details of the complainants, witnesses, and barristers, and details of the complaints.

The Bar Council has taken steps to notify relevant complainants and any others who might be affected, as well as to notify all barristers, and all Bar Council and BSB lay committee members.

The Chief Executive of the Bar Council, David Hobart said: “I am sorry that, as a result of this burglary, barristers and some members of the public have had data stolen from the Bar Council office in Holborn.

“At present the signs are this was a random burglary, but to be sure we will have to wait for the outcome of the police investigation.

“I want to reassure anyone who may be concerned that the stolen data is correctly and safely protected, and I am confident that no one will suffer loss as a result.”

A Bar Council help line has been set up on 0207 611 1418 for anyone with specific concerns about the implications of this crime.
