Barclays wins injunction against publication of 'tax dodge' memos
The bank was last night granted an emergency injunction barring The Guardian from publishing leaked memos on its website

Barclays today obtained a court order forcing a newspaper to remove from its website documents that allegedly show how the bank avoided hundreds of millions of pounds in tax.

Barclays' lawyers Freshfields Bruckhaus Deringer worked into the early hours of the morning to force The Guardian to remove the internal memos, which allegedly show communications between executives in the bank's structured capital markets division.

Mr Justice Ouseley granted the injunction shortly after 2am after waking the newspaper's solicitor, The Guardian's website reported.

The documents, leaked by a whistleblower, reportedly showed several schemes under which the bank allegedly sought to avoid taxes by taking out a series of international loans.

Summary

On Monday 16th March 2009, The Guardian newspaper in the United Kingdom published a series of leaked memos from the banking giant Barclays, together with the article:

The next day, these documents were removed from The Guardian web archive, as a result of a court injunction obtained in the middle of the night:

Barclays' lawyers, Freshfields, worked into the early hours to force the Guardian to remove the documents from the website. They argued that the documents were the property of Barclays and could only have been leaked by someone who acquired them wrongfully and in breach of confidentiality agreements.

The Guardian's solicitor, Geraldine Proudler, was woken by the judge at 2am and asked to argue the Guardian's case by telephone. Around 2.31am, Mr Justice Ouseley issued an order for the documents to be removed from the Guardian's website.

The documents are copies of alleged internal memos from within Barclays Bank. They were sent by an anonymous whistleblower to Vince Cable, Liberal-Democrat shadow chancellor. The documents reveal a number of elaborate international tax avoidance schemes by the SCM (Structured Capital Markets) division of Barclays.

According to these documents, Barclays has been systematically assisting clients to avoid huge amounts of tax they should be liable for across multiple jurisdictions.

A commentator to the Financial Times stated:

I was lucky enough to read through the first of the Barclays documents...

I will say it was absolutely breathtaking, extraordinary. The depth of deceit, connivance and deliberate, artificial avoidance stunned me. The intricacy and artificiality of the scheme deeply was absolutely evident, as was the fact that the knew exactly what they were doing and why: to get money from one point in London to another without paying tax, via about 10 offshore companies. Simple, deliberate outcome, clearly stated, with the exact names of who was doing this, and no other purpose.

Until now I have been a supporter of the finance industry - I work with people there regularly and respect many of them, and greatly enjoy the Financial Times and other financial papers. However this has shone a light on something for me, and made me certain that these people belong in jail, and companies like Barclays deserve to be bankrupt. They have robbed everyone of us, every single person who pays tax or who will ever pay tax in this country (and other countries!), through both the bailouts and schemes such as this.

The great Australian Firewall might be struggling to make political progress, but regulators are already using its blacklist to threaten local websites with fines.

Broadband discussion forum Whirlpool was threatened with an A$11,000 (£5,148) a day fine by the Australian Communications and Media Authority because a commenter posted a link to an anti-abortion website which appeared on the regulator's list of websites banned in Australia.
The takedown notice was sent to Whirlpool's hosting service Bulletproof Networks. Bulletproof contacted Whirlpool which agreed to remove the web link.
But the story gets murkier - ACMA added the website to its secret blacklist after receiving a complaint about one page on the site from someone in Melbourne with the user name Foad........

Wikileaks was added to the blacklist for publishing a leaked document containing Denmark's list of banned websites.

The banking/lawyers/intelligence/organised crime network sure was busy last night

Personally I am sure that Barclays Bank is way-over-bust and this censorship is a desperate 'throw money at the lawyers' attempt to preserve its name for a few more weeks.

Please pass round the leaked Barclays documents to all and any journalists and police forces that you can.

Summary

The first rule of censorship is that you cannot talk about censorship.

In late 2008, Wikileaks released the secret Internet censorship list for Denmark, together with a press release condemning the practice for lack of public or judicial oversight. Here's an extract from the press release:

The list is generated without judicial or public oversight and is kept secret by the ISPs using it. Unaccountability is intrinsic to such a secret censorship system.

Most sites on the list are still censored (i.e must be on the current list), even though many have clearly changed owners or were possibly even wrongly placed on the list, for example the Dutch transport company Vanbokhorst.

The list has been leaked because cases such as Thailand and Finland demonstrate that once a secret censorship system is established for pornographic content the same system can rapidly expand to cover other material, including political material, at the worst possible moment -- when government needs reform.

Two days ago Wikileaks released the secret Internet censorship list for Thailand. Of the 1,203 sites censored this year, all have the internally noted reason of "lese majeste" -- criticizing the Royal family. Like Denmark, the Thai censorship system was originally promoted as a mechanism to prevent the flow of child pornography.


An Australian anti-censorship activist submitted the page to the Australian Communications and Media Authority (ACMA), requesting that they censor it, under their internal guidelines. The activist wished to expose the "slippery scope" of the proposed Mandatory Internet Censorship scheme.

The press release and the list itself have now been placed into the secret Australian government blacklist of "Prohibited Online Content".

The content on the blacklist is illegal to publish or link to in Australia, with fines of upto $11,000 a day for contraventions.

The ACMA blacklist is proposed to become the list with which the Australian Government will mandatory block all Australians Internet requests. Presently censorship of access attempts by ISPs is voluntary. The Australian government has faced strong opposition over the scheme, with the Liberal (conservative) and Green (liberal left) opposition parties stating they will vote against it.

The downloadable file contains a PDF of the request. What follows is the emailed reply from ACMA, agreeing to the censorship request. At no stage did the Australian government contact Wikileaks.

Australia, and that the content is prohibited content or potential
prohibited content as defined by Schedule 7 to the Broadcasting
Services Act 1992.

The Internet Industry Association (IIA) has a code of practice
(http://www.iia.net.au/index.php?option=com_content&task=view&id=415&I temid=33)
for Internet Service Providers (ISPs) which, among other things,
sets out arrangements for dealing with such content. In accordance
with the code, ACMA has notified the above content to the makers
of IIA approved filters, for their attention and appropriate action.
The code requires ISPs to make available to customers an IIA approved
filter.

On this occasion ACMA has also referred the matter to the appropriate
law enforcement agency.

yup, it's back up again now.

This secret censorship of Dentists, Christian pro-life groups and tour guides under the guise of 'child pornography' is proof positive that these internet watchdogs are corrupt or corruptable.

War on Christian ideas and values is just part of the War Of Terror in my opinion.

Not sure about dentist though. Is the attack on NHS Dentists part of the war??
