There has been a terrorist incident in Ipswich.

The incident occurred on 17.11.2010

A man was charged under Section 36(2) of the Trerrorism Act 2000.

I believe he is the first person to be charged under Section 36 since the Act came into force on 19.2.2001

36 Police powers.

(1)A constable in uniform may—

(a)order a person in a cordoned area to leave it immediately;

(b)order a person immediately to leave premises which are wholly or partly in or adjacent to a cordoned area;

(c)order the driver or person in charge of a vehicle in a cordoned area to move it from the area immediately;

(d)arrange for the removal of a vehicle from a cordoned area;

(e)arrange for the movement of a vehicle within a cordoned area;

(f)prohibit or restrict access to a cordoned area by pedestrians or vehicles.

(2)A person commits an offence if he fails to comply with an order, prohibition or restriction imposed by virtue of subsection (1).

(3)It is a defence for a person charged with an offence under subsection (2) to prove that he had a reasonable excuse for his failure.

(4)A person guilty of an offence under subsection (2) shall be liable on summary conviction to—

(a)imprisonment for a term not exceeding three months,

(b)a fine not exceeding level 4 on the standard scale, or

(c)both.

What are Police Constables doing enforcing Statute Law in the first instant?

They are only mandated to enforce common law and only in the upkeep of the peace.

The person arrested must first have to have identified him/herself as their commercial debt account in the public.

This needs to be fully understood..

I worked in Ipswich for a period of six weeks 2006. It is a very strange place and I have to say the water they drink down there is absolutely putrid to the point I had a distinctive metal taste to the back of my mouth after I drank a tea from Macdonalds.

This was before the murder of the prostitutes over the following season. The best description of the feelings I had while in the area of Ipswich would be towards a very structured atmosphere and one the Intelligence forces would use to drill certain scripts to drive legislation, with this incident makes two such drills.

A businessman has been charged under the Terrorism Act after he broke through a police cordon and tipped open two suspect packages to prove they were harmless.
James Mullan ducked under police tape and emptied old clothes and shoes from bags left in Ipswich town centre after become frustrated by the lengthy wait for a bomb scare to be resolved.
Mullan, a watch repairman, was given a conditional discharge at South East Suffolk magistrates' court after his 'reckless' behaviour last month.

Police closed the market on the Cornhill in Ipswich and evacuated nearby buildings and a market after the bags were found abandoned at 2.30pm on November 17.
Mullan, of Kesgrave, Suffolk, became upset about the closure continuing while police waited for an Army bomb disposal team to arrive from Colchester, Essex.
And at 5.10pm he took the law into his own hands and dodged around police to open the bags in a council customer service centre beside the town hall.
The 62-year-old was arrested when he emerged from the office and told police that the bags were harmless.
The watch repairman said he had become frustrated by a perceived lack of police activity during the drama and wanted to resolve the situation himself.
The court heard how a number of market traders had also become frustrated because they were losing trade.

Jeremy Kendall, defending Mullan, said: 'The defendant knew from previous experience that a bomb disposal team would have to come up from Colchester and he wanted to act sooner.
'He went through the cordon and into the building and opened the bags which were full of clothes and shoes.
'What he did was stupid,' Mr Kendall admitted. 'Had the device been explosive then he would clearly have endangered his own safety. But he felt there was an unexplained delay and wanted to help, not hinder.

'Ironically, he did help the operation by revealing there was nothing explosive there.'
Mullan admitted a charge of breaking through a police cordon, an offence under Section 36 (2) of the Terrorism Act 2000.
District Judge David Cooper gave him a conditional discharge for a year and ordered him to pay (£85 costs.
Judge Cooper told him: 'You were reckless and impatient. As an upstanding member of the community you must abide by police cordons.'

The court heard how police reopened the area to the public at 5.30pm after Mullan's actions proved the rucksack and holdall did not contain explosives.

Mistake: James Mullan, who has been given a conditional discharge after being charged under the Terrorism Act, said he did not realise he had broken the law
Mullan later insisted that he did not realise he was breaking the law when he took matters into his own hands.

'If I had known I was breaking the law I would not have done what I did. would not do it again, but I was just trying to help' he stressed.

'As soon as the cordon went up, business is dead for lots of people in Ipswich. All the market traders had to pack up and leave the market.

'I just thought someone must have put the bags down and forgotten about them. I thought I was doing everyone a favour by just having a quick look.

'My intentions were 100 per cent good. In hindsight, with 20-20 vision my motive was to help everybody.'

Ipswich: Arrest over Town Hall bomb hoax

A man has been arrested following the evacuation of the Town Hall customer service centre.

Suffolk police have confirmed that a 20-year-old man from Ipswich was arrested in the town at 2.50pm yesterday on suspicion of communicating false information in relation to a bomb hoax.

The arrest follows the discovery of suspect packages that led to a mass evacuation of the Town Hall, market square and surrounding buildings from 2.30pm on Tuesday.

The man has been bailed to return to Bury St Edmunds police station at 2pm Tuesday, December 7 pending further enquiries.

So the moral of the story is Dont report suspicious packages- it might get you arrested if it turns out to be someones laundary
