Australia halts Indian doctor's bail release

Well the Doctor apparantly has committed the grave crime of supplying a SIM card to one of the people LINKED to the Scottish suspects. As you all know sim cards are given away free by most mobile companies and pay as you go sim cards are often passed around as they have only value in any unused credits or texts. Once again the logic of it escapes me, why wouldn't a terrorist be able to get his own sim card anywhere and for any network of his choice? Getting a sim card is easier than getting a pint of milk.

And as the court quite rightly judged, if his only crime was supplying a sim card then he is entitled to bail. But the Australian government on Monday stopped an Indian doctor charged in connection with the failed UK car bombings from being released on bail. It cancelled his visa and ordered him into an immigration detention centre.

Doctor Mohamed Haneef, 27, has been in custody since July 2 but was only charged on Saturday, sparking criticism by civil rights groups of his 12-day detention without charge. Australian Federal Police (AFP) have charged Mr Haneef with "providing support to a terrorist organisation" because he left his mobile phone SIM card with his second cousin, one of those linked to the attacks in London and Glasgow.
John Howard, Australian Prime Minister, has defended anti-terrorism laws which allowed Mr Haneef to be detained for 12 days before being charged, saying the laws are essential to protect Australian citizens.

An Australian court magistrate on Monday granted Mr Haneef A$10,000 (US$8,700) bail, saying he had no known links to a terrorist organisation and that police were not alleging that his SIM card had been used in relation to the British terror plot. Mr Haneef's barrister Stephen Keim argued for his release, saying the case against Mr Haneef was "extremely weak".

But within hours the Australian government stopped Mr Haneef's bail release by cancelling his visa and ordering him placed in Sydney's Villawood immigration detention centre. Mr Haneef's case was adjourned to August 31. Mr Haneef will now be held in immigration detention until his trial. He will then be deported if he is acquitted of any crime, or once he has completed any sentence.

Being completely sceptical as I am regarding everything reported about these silly 'Al-Qeada petrol' bombers, and the links to so called "Doctors", I have also been aghast at this ridiculous story from Australia that this chappie "supports" terrorism because he left a mobile phone SIM (and my understanding is that this was left something like two years ago!!!) with his second cousin. Soon we'll be linked for stupid reasons such as our surname starts with an 'S' (or whatever).

It just shows how deperate the PTB are to link nornal events to whole groups of people and so build up these huge "terrorist cells", splashing it out in the mainstream media propaganda machine, so making the sleeping populace feel frightened.

Who are the real terrorists here?? Seems to me our own ruling elite and their gutterpress propaganda servants.

Furthermore, I thought that one of the whole things regarding the courts was that judges are independent. So if the Oz judges wished to release this bloke on bail, does it not show us that ultimately the Governments control our judiciary?

I've been reading up on the issue of recruitment of Junior Doctors, particularly of foreign origin within the context of the on-going battle against the former Health Secretary, Patricia Hewitt's Modernising Medical Careers (MMC) program announced on 1st August 2005.

You may well recall the demonstrations by some 12,000 Doctors who took to the streets of London on March 17th 2007 and the follow up action lobbying MPs in Parliament on 24th April 2007.

See the Remedy UK Campaign website for details.

Remedy UK characterise the MMC program thus:

Remedy UK wrote:
what is mmc?

Modernising Medical Careers (MMC) is a government initiative to revamp and modernise current training of doctors within the UK.

why was mmc implemented?

The reasons for MMC are not fully apparent. There were certainly some problems with the old system but MMC is a complete overhaul of a reasonably successful training method.

The overall outcome of MMC is skimpier, inflexible, fast-track and narrowly specialised training programme. It will eventually lead to more junior, less qualified and less condifident consultants then the older training programme. Only the government knows the reason to want increase the numbers of inexperienced junior consultants.

who does it affect?

MMC affects the vast majority of junior doctors who are currently many years into training to be leading specialists in their fields in the NHS

how many doctors will be unemployed as a result of mmc?

8000 doctors in August 2007. Thee may also be further unemployment or lack of training opportunites in August 2008, precipitating further exodus.

how much does it cost to train a doctor?

£250,000 per doctor - paid for by the UK tax payer. This means a total £2 billion worth of trained doctors being unemployed.

where will our trained doctors go?

Many doctors are migrating abroad with a view to a permanent emigration. not because of a lack of dedication and passion for the NHS but because of of the inflexibility of the new system and lack of training.

Others will change career entirely.

You may also recall news stories concerning the web based Medical Training Application Service (MTAS) that prospective Junior Doctors are supposed to use to apply for training vacancies.

Remedy UK have this to say about MTAS:

Remedy UK wrote:
what is mtas?

MTAS stands for the Medical Training Application Service - an online application system designed to allow juniors to apply centrally for training rotations. However, it has been prone to crashing, as it was clearly incapable of dealing with the volume of traffic attempting to access the site.

It restricts the applications of juniors to only 4 areas of the country, which may be extremely large - for instance Scotland is one Unit of Application, as are London, Kent, Surrey and Sussex together. Previously juniors could apply to any hospital they wanted, anywhere in the country.

Deadlines for MTAS were extended due to the inability of the website to cope, and changes made to the application process during the two weeks in which it was running. Shortlisting was not completed in time, and there are concerns that it was never completed in some areas.

how is the new system choosing our future doctors?

It requires juniors to submit an online application form, much of which involves 150 word vignettes about clinical cases or ethical issues. 75% of the marks available are awarded for these vignettes, only 25% for actual clinical and academic qualifications.

The evidence for this recruiting system is untried and unproven. From initial feedback, it has become clear the system in no way descriminates between highly suitable and highly unsuitable candidates

how did the old system choose doctors?

Although there were flaws in the old system, it was analysed applicants based on the follwoing:

1. Academic achievements - Passing post graduate exams were an essential selection criteria for many jobs. This insured applicants were knowledgable and well versed in the speciality they chose to pursue. It meant your doctor would have proven record of being a specialist in the field.

These exams are world recognised and respected exams.

2. Research - Involvement in research and having publications in world recognised journals ensured candidates to jobs were recognised for helping to advance medical research and ensure the UK remained at the forefront of medical science.

3. Extra curricular activities - Doctors with a wide range of exceptional activites outside of medicine were recruited as all round, well balanced individuals. Such activities are no longer essential to be a trainee.

4. References - a reference from a supervisor, one of the most valuable tools used in any job application for any industry largely sidelined and confined to a tick-box form.

were junior doctors consulted in mmc?

The British Medical Association and Royal Colleges of the UK have been in the process and informed of the events. Evidence suggests these organisations warned the government of serious reservations about MMC and especially the timescale the government planned to implement it.

hasn't it always been competitive?

Yes, Medicine has always been competitive from originally applying to medical school to applying for consultant posts. Doctors accept it is competitive but also require a system that is meritocratic and fair. This is why many doctors continually move to different parts of the country, sacrificing other commitments in order to be as competitive as possible for the career they desire.

Doctors however also expect to have certain rights when applying to jobs like any other worker in the country. These do not appear to have been the case here - for example, having almost no idea to which part of the country they may get posted to or knowing the job description/salary of the job they are applying for.

That background sets the scene in which the current scandal imposed on Junior Doctors can be understood.

In addition to the MMC and it's ensuing debacle there have been significant developments recently with regard to the recruitment of doctors of foreign origin.

A significant contingent among the medical professionals, protesting in London on April 24th were junior doctors who recruited from overseas.

Blink has this:

BLINK wrote:
Sickening: betrayal of foreign doctors
by Shirin Aguiar-Holloway
24/4/2006

THE HOME OFFICE misled foreign doctors with the surprise introdution of new rules preventing them from working in the NHS.

Protests by doctors in Westminster on Friday.
Hundreds of overseas doctors are facing career ruin after the government sprang a new law preventing them completing their UK training protested today in central London.

Thousands of trainee doctors, many of whom were consultants back in India, have been betrayed by a sudden rule change brought in by immigration minister Tony McNulty.

The new rules mean most non-EU doctors cannot complete NHS training without work permits. Six hundred doctors protested outside the Department of Health today, saying the changes leaves their lives and careers in ruins.

frantic

Until recently, overseas doctors, many of whom are Indian, could come to train in the UK without a work permit.

cap

Dr Satheesh Matthew: 'we have been betrayed'
The work permit-free deal, aimed at helping the NHS make up numbers and rapidly expand its provision, led to doctors from countries including India playing a key part in the NHS's growth - comprising up to 70% of all doctors in some areas of Britain.

But under the new rules, introduced suddenly this month, these doctors and dentists will no longer be able to automatically seek training placements.

Hospitals must prove they cannot recruit a junior doctor from Britain or the EU before they can shortlist candidates from other countries.

Doctors' groups and campaigners, including the Indian High Commissioner, have been frantically lobbying ministers.

unreasonable

The British Association of Physicians of Indian Origin (Bapio) says at least 15,000 doctors may have to leave the UK heavily in debt and without having completed qualifications, despite having been encouraged to come to the UK in the first place.

Many of these are already unemployed because of shortage of available training posts. Many had sold their homes, taken out loans and left their families behind to work in Britain and are now faced with the prospect of returning home with debt but no diploma or qualifications.

Dr Satheesh Mathew from the BAPIO told Blink: "Britain has the right to favour its own graduates and we are with them in that respect. What was unreasonable was without warning you did this to us.

"These doctors who have come here will have written Plab exams. They expected they would get a decent job and complete their training. They have been betrayed."

A. Sajayan, 36, a clinical fellow in intensive care at Newham General Hospital in east London, came to the UK in 2003, has completed his senior house officer (SHO) training and is halfway through his training for the registrar post.

homegrown

He told Blink he came to Britain because in India Western degrees were held in esteem and doctors trained here considered better than others. The news has been a bitter blow.

"I'm at a loss. At the moment I'm working as an SHO but I can't complete my examination and fellowship. I cannot become an HPR registrar now. Ninety per cent of doctors here are in similar positions. We're not asking for them to look at us as homegrown doctors. The GMC (General Medical Council) never gave us a warning there wouldn't be a post."

Mr Sajayan, who worked as a consultant in Kerala, in south India, and has a wife and two children, asked why the GMC was still conducting (Plab) linguistic qualification examinations: "If there are no jobs why is the GMC still conducting these overseas?"

He said that doctors come "in good faith" that they can complete their training, and branded the news that preference would from now be given to European candidates as "clear discrimination."

He also blamed the Home Office for failing to consult with the Department of Health and the GMC before implementing the changes, adding: "The right hand doesn't know what the left hand is doing."

dignity

He added: "The only option is to keep my post, feed my family and go back and keep my dignity."

But a spokeswoman for the GMC admitted it had been consulted by the Home Office last year but said it had no idea when the changes would be brought in. She added: "As soon as the announcement was made we updated our website about work permits."

A spokesperson for the DoH said there were now more than 117,000 doctors working in the NHS, as well as record levels of doctors in training in UK medical schools, adding: "We do not need to rely on overseas doctors as much as we did in the past."

The DoH was slammed by the British Medical Association, the professional association for doctors, which accused the government of changing the rules without any regard for welfare, and by the Royal College of Physicians.

Dr Jo Hilborne, chairman of the BMA's Junior Doctors Committee, said: "What the government is doing is unfair on the doctors who are already here."

undermined

An RCP spokesman said the government had gone about it the wrong way: "The college recognises the contribution of overseas doctors has often been undervalued and their aspirations undermined.

"They now hear a message that they are no longer needed or wanted and that their commitment to the NHS has counted for little. On completion of their training, many doctors returned home to practice.

"The spread of medical skills learnt in the UK is a tradition that we have reason to be proud off. It is difficult to see how this can be maintained under the proposed arrangements."

Arun George, 27, an SHO at Manor Hospital in Walsall, West Midlands, said he had not slept for four weeks since hearing the news. He said Mr McNulty had promised to look into the matter.

He accused health secretary Patricia Hewitt of "not responding" and said her department were "extremely uncooperative." He praised the royal bodies for their support.

He added: "It's a double blow as jobs are being given out now for next year. Who is going to compensate? We have lost already."

So, now we have a new piece of the puzzle called BAPIO to consider.

BAPIO is the acronym for the British Association of Physicians of Indian Origin.

BAPIO obtained an emergency injunction against the Department of Health on 4th March 2007 preventing Hewitt's Department of Health from introducing a new requirement into the MTAS application process.

What the D of H snuck into the MTAS rules at midnight on 23rd February 2007 was that any foreign born doctor that did not have a visa valid for 1st August 2007 would be turned away from MTAS training interviews, effectively ending their career as a UK Junior Doctor.

Back in February 2007 this happened:

Quote:
London High Court upheld a new rule, Foreign doctors in jeopardy

LONDON, Feb. 09, 2007
Col. Harbakash Singh

Last Friday, the London High Court upheld a new rule, declining to quash the Immigration Regulations that came into force on April 3, 2006, leaving nearly 16,000 Indian doctors and Arab doctors 6,000 in jeopardy. More than 10,000 trainee doctors will have to leave the country with the new law.

The new rules will begin from July 7 and after that only doctors from the European Union can work without a permit.

The new rules will favor European Union and home-grown UK doctors, non-EEA (European Economic Area) graduates hoping to continue their training in the UK will have to apply for work permits rather than, as previously allowed, enter with a student visa.

The 4th March emergency injunction was followed up by the Department of Health conceding a case brought by BAPIO at the High Court on March 8th, as reported by the Times of India here

Times of India wrote:
Indian docs win important legal battle in UK
9 Mar 2007, 1009 hrs

LONDON: Indian doctors have won a significant legal battle in the High Court of Justice as the British government agreed to withdraw a “discriminatory clause” which would have excluded them from job interviews and appointment process if they did not have visas beyond August 1, 2007.

The High Court was due to hear on Thursday the application filed by the British Association for People of Indian Origin (BAPIO) for permission to take a judicial review of the injunction on rules affecting Highly Skilled Migrant Programme (HSMP) doctors.

As the judge began the hearing on Thursday, the Secretary of State's Counsel requested a brief adjournment. BAPIO was then informed that the Secretary of State was prepared to concede.

“BAPIO accepted this offer and agreed to withdraw the case since the Secretary of State gave an undertaking to the court that this clause will be removed,” Dr Ramesh Mehta, President of BAPIO, said on Friday.

“For the first time a clear message has been sent out that promises made to International Medical Graduates (IMGs) must be kept. HSMP doctors were allowed in to make UK their home; HSMP doctors must be treated at par with UK and EU nationals and there is no basis for discriminating against them,” Mehta said.

On March 4, BAPIO obtained an emergency injunction to prevent discrimination of doctors on HSMP visa whose visas were due for renewal before August 1, in the first round of the current recruitment for 21,000 training jobs.

This was necessary because while the Department of Health had agreed to keep the new rules discriminating against HSMP doctors in abeyance, it had introduced a new clause which stated that to be considered for the interview these doctors must have HSMP visa that was current on August 1, 2007.

BAPIO believed that this would be a disadvantage for many international doctors whose visas came up for renewal before this date and hence filed for and obtained this injunction.

Dr Raman Lakshman, Vice Chair for Policy, said: “We had many doctors writing to us expressing concern that they will be refused an interview even though they had been short-listed. We therefore had no option but to file for the injunction. We were sure we would have won if the case had been heard. We are pleased that the Department of Health has conceded and we hope there will be no further obstacles for HSMP doctors.”

“This marks a great day in the history of IMG in the UK. At long last IMG have been able to assert their right to be treated fairly. We thank our barristers, solicitors and legal team for their efficient and effective action,” said Dr Satheesh Mathew, Vice Chair for Operations.

Meanwhile, a spokesman of the UK Visas said on Friday certain “transitional arrangements” have been made for Highly Skilled Migrants in the UK to ensure that they qualify for further leave to remain. He said in all 40,713 applications were received from outside of the UK for consideration under HSMP during 2006 and of them 21,948 applications were approved. Of the 14,716 applications for renewal of leave under HSMP in 2006, 14,109 were approved.

An appeal is scheduled for October 30th.

We then have an alleged terrorist incident, allegedly involving Indian doctors [ED: Actors surely !] playing Al Qaeda type games, which, coincidentally has the incredibly timely effect of attempting to discredit, erm, why Indian doctors of course !

[ED: Only the ones that self-immolate, surely !]

This is followed by Al Q's No 2, Al-Zawahiri's audio statement of July 10th entitled "Malicious Britain and it's Indian Slaves" aimed at the lovely Mr Rushdie.

Terrorism (ED: pseudo terrorism surely) as a useful political tool ?

That would be just another reckless conspiracy theory.

Wouldn't it ?

I agree with you. I think the reason they have picked on Indian doctors is to solve the problem of UK junior doctors unable to find work.

This shows what a complete ass Gordon Brown is. After being the worst chancellor and the highest taxing he has now moved further in policy than even the BNP. Start with cleansing the NHS of all foreign doctors.
But this will soon be followed by school teachers and university lecturers - after all they were the ones who voted to boycott Israel recently. Eventually Gordon Brown will be exposed but at the moment his BNP tactics have given him a boost in the opinion polls. How easy it is to fool the great unwashed masses with a burning car and a mobile phone sim card.

Well, b*gger me, what a surprise (I think not!!), the Aussie Authorities have released this chappie.

Australia's chief prosecutor Damian Bugg intervened to review the evidence against Haneef after weeks of media leaks and growing public criticism about the lack of strong evidence against the doctor. "In my view of this matter, a mistake has been made," Bugg told reporters in Canberra.

A "mistake"??

See http://uk.reuters.com/article/worldNews/idUKSYD26830320070727
and http://news.bbc.co.uk/1/hi/world/asia-pacific/6918569.stm

Note how this sort of news is tucked away in the bowels of the media reports, whereas his initial arrest, and those of other alleged "terrorists", are splashed all over the front pages!!

Yes its a farce... Doctors aren't Terrorists. They are poisoners. How to get them to wise up to these vaccinations and dangerous drugs they hand out like smarties is the next question.

In case anyone doesn't realise the illuminati companies provide drugs full of nonsense such as:

Sodium Hydroxide which can cause blindness, lung and tissue damage,
Formaldehyde, a neurotoxin and carcinagenic, Hydrochloric Acid which is also found in aluminium cleaners and rust removers, Aluminium, Thimerosal, a mercury derivative formed from ethylene glycol (antifreeze) and ethanol, thiosalicyclic acid, sodium hydroxide and ethyl mercuric chloride and cause cancer, brain and liver damage, phosphates which are also found in laundry and dishwasher detergents and cleaners.
Then there's Ritalin and a multitude of other drugs given to children.

The list is never ending and make no mistake this stuff is deadly and kills millions world wide. Perhaps Aids and Sars are man made etc. etc. etc.

Do not blindly accept vaccinations. They are not what they appear. If people knew the truth about some so-called alternative therapies/medicine they would be a lot less keen to get down the doctor's.

And the kicker is I don't think most doctor's are aware themselves. They seem to accept this stuff on faith.

There seems be an on-going pattern here: Arrest the suspects wiith much clashing of cymbals and beating of drums. Then release them, without charge, days or weeks later, with little or no fuss or publicity. What does stick, in the mind of the general public, however, is the fact and memory of their arrest.
