(NaturalNews) As part of a new expansion of government power over information, the Department of Homeland Security has begun seizing and shutting down internet websites (web domains) without due process or a proper trial. DHS simply seizes web domains that it wants to and posts an ominous "Department of Justice" logo on the web site. See an example at http://torrent-finder.com

Over 75 websites were seized and shut down last week, and there is no indication that the government will stop such efforts. Right now, their focus is websites that they claim "violate copyrights," yet the torrent-finder.com website that was seized by DHS contained no copyrighted content whatsoever. It was merely a search engine website that linked to destinations where people could access copyrighted content. Google also links to copyrighted content -- does that mean the feds will soon seize Google, too?

These seizures were conducted on the basis of language in the DMCA law, which is vastly overreaching in its powers (it was passed to appease the music recording industry and the RIAA). Even so, the U.S. Senate is right now considering passing yet another law -- COICA -- the Combating Online Infringement and Counterfeits Act....

U.S. Government Seizes 82 Websites: A Glimpse at the Draconian Future of Copyright Enforcement?

Over the past few days, the U.S. Justice Department, the Department of Homeland Security and nine U.S. Attorneys’ Offices seized 82 domain names of websites they claim were engaged in the sale and distribution of counterfeit goods and illegal copyrighted works.

Setting aside the due process concerns inherent in seizing any website without notice or appropriate recourse for the owner, it appears that the "raid" has swept up several sites that are hardly in the business of willful copyright infringement. For example, the the list of targets included OnSmash.com and RapGodfathers.com. Both sites are dedicated to promoting rap and hiphop, showcasing new artists and helping fans connect and share information about the music they love. According to the owners, they regularly and expeditiously process copyright infringement notices and take down links as appropriate. Indeed, OnSmash says the labels themselves are often the source of the links OnSmash makes available. In other words, they try to play by the rules. Moreover, the sites are not simply collections of links; rather, they provide a wide array of information and forums for speech, all of which was rendered inaccessible by the seizure.

This type of seizure is not unprecedented, but we haven’t seen it happen on such a broad scale before. This kind of mass action raises at least three concerns:

First, these seizures may be just a short preview of the kind of overreaching enforcement we’ll see if the Congress passes the Combating Online Infringement and Counterfeits Act (COICA). That bill, which was approved by the Senate Judiciary Committee on Nov 18, gives the government dramatic new copyright enforcement powers, in particular the ability to make entire websites disappear from the Internet if infringement, or even links to infringement, are deemed to be "central" to the purpose of the site. Rather than just targeting files that actually infringe copyright law, COICA’s "nuclear-option" design has the government blacklisting entire sites out of the domain name system — a reckless scheme that will undermine global Internet infrastructure and censor legitimate online speech. As we’ve noted, one of the most pernicious effects of COICA is likely to be just what we’ve seen here: the takedown of legitimate speech.
Second, the seizures also show why this kind of enforcement doesn’t work; seized sites were available at other domain names within hours. If the United States government increases interference in critical DNS infrastructure to police alleged copyright infringement, it is very likely that a large percentage of the Internet will shift to alternative DNS mechanisms that are located outside the US. This will cause numerous problems — including new network security issues, as a large percentage of the population moves to encrypted offshore DNS to escape the censoring effects of the procedures outlined in COICA. Presumably the DOJ and the DHS should be committed to improving network security — not undermining it.
Third, it’s hard to believe that this kind of action is the best use of the Department of Homeland Security’s resources. What investigations didn’t occur while the DHS spent its time and energy pursuing the agenda of large media companies? Moreover, it’s highly unlikely that this publicity stunt will really help creators get compensated. The best way to help artists of every stripe get compensated for their work is to make sure that there is a thriving marketplace of innovative digital businesses to pay them — business like OnSmash, which is committed to promoting new and unheralded artists.
We hope the legislators considering COICA will take a hard look at these issues before they vote. In the meantime, government officials should take an equally hard look at their enforcement priorities before they spend more of our tax dollars chasing websites.

The domain seizures by the United States authorities in recent days and upcoming legislation that could make similar takeovers even easier in the future, have inspired a group of enthusiasts to come up with a new, decentralized and BitTorrent-powered DNS system. This system will exchange DNS information through peer-to-peer transfers and will work with a new .p2p domain extension.

In a direct response to the domain seizures by US authorities during the last few days, a group of established enthusiasts have started working on a DNS system that can’t be touched by any governmental institution.

Ironically, considering the seizure of the Torrent-Finder meta-search engine domain, the new DNS system will be partly powered by BitTorrent.

In recent months, global anti-piracy efforts have increasingly focused on seizing domains of allegedly infringing sites. In the United States the proposed COICA bill is explicitly aimed at increasing the government’s censorship powers, but seizing a domain name is already quite easy, as illustrated by ICE and Department of Justice actions last weekend and earlier this year.

For governments it is apparently quite easy to take over the DNS entries of domains, not least because several top level domains are managed by US-based corporations such as VeriSign, who work closely together with the US Department of Commerce. According to some, this setup is a threat to the open internet.

To limit the power governments have over domain names, a group of enthusiasts has started working on a revolutionary system that can not be influenced by a government institution, or taken down by pulling the plug on a central server. Instead, it is distributed by the people, with help from a BitTorrent-based application that people install on their computer.

According to the project’s website, the goal is to “create an application that runs as a service and hooks into the hosts DNS system to catch all requests to the .p2p TLD while passing all other request cleanly through. Requests for the .p2p TLD will be redirected to a locally hosted DNS database.”

“By creating a .p2p TLD that is totally decentralized and that does not rely on ICANN or any ISP’s DNS service, and by having this application mimic force-encrypted BitTorrent traffic, there will be a way to start combating DNS level based censoring like the new US proposals as well as those systems in use in countries around the world including China and Iran amongst others.”

The Dot-P2P project was literally started a few days ago, but already the developers are making great progress. It is expected that a beta version of the client can be released relatively shortly, a team member assured TorrentFreak.

The project has been embraced by many familiar names in the P2P-community. Former Pirate Bay spokesman Peter Sunde is among them, and the people from EZTV have been promoting it as well.

“For me it’s mostly to scare back. To show that if they try anything, we have weapons of making it harder for them to abuse it. If they then back down, we win,” Peter Sunde told TorrentFreak in a comment.

Although the initiators of the project are still debating on various technical issues on how the system should function, it seems that the administrative part has been thought out. The .p2p domain registration will be handled by OpenNIC, an alternative community based DNS network. OpenNIC also maintains the .geek, .free, .null and several other top level domains.

On the other hand, there are also voices that are for distributed domain registration, which would keep the system entirely decentralized.

The domain registrations will be totally free, but registrants will have to show that they own a similar domain with a different extension first, to prevent scammers from taking over a brand.

The new P2P-based DNS system will require users to run an application on their own computer before they can access the domains, but there are also plans to create a separate root-server (like OpenNIC) as a complimentary service. It’s worth noting that the DNS changes will only affect the new .p2p domains, it will not interfere with access to any other domains.

It will be interesting to see in what direction this project goes and how widely it will be adopted. There are already talks of getting Internet Service Providers to accept the .p2p extension as well, but even if this doesn’t happen the system can always be accessed through the BitTorrent-powered application and supporting DNS servers.

If anything, this shows that no matter what legislation or legal actions are taken, technology stays always one step ahead. The more aggressive law enforcement gets, the more creative and motivated adopters of the Open Internet will respond.

Microsoft Buys Skype for $8.5 Billion. Why, Exactly?

Just days after reports that Google and Facebook were interested in partnering with, and possibly buying VoIP company Skype, Microsoft announced that it was buying the company for $8.56 billion in cash.

Last year, Skype had revenue of $860 million on which it posted an operating profit of $264 million. However, overall it made a small loss of $7 million, and had long-term debt of $686 million. This is the second time Skype has been bought out; after being started in 2003, it was purchased by eBay in 2005 for $3.1 billion. EBay then sold the majority of its stake in 2009 to a private investment group for $1.2 billion less than it paid.

The purchase was Microsoft’s biggest ever, surpassing even the $6 billion acquisition of advertising firm aQuantive in 2007. That alone makes it surprising; the company’s track record with large purchases is decidedly mixed. Danger, the exciting mobile technology company that produced the Hiptop, better known as the T-Mobile Sidekick line, was purchased for an estimated $500 million in 2008; the result of that purchase was the disastrous KIN phone and a complete failure to integrate the bought-in talent. The aQuantive purchase too had mixed outcomes, with Redmond unable to find a role for the Razorfish division before eventually selling it off in 2009; Microsoft continues to be unable to make a profit from online advertising.
Microsoft has in the last couple of years shied away from similar large acquisitions, sticking to buying smaller, easier-to-manage organizations, leading some to argue that this was a direct result of the digestive difficulties faced with the large purchases. A $7 billion Skype acquisition would show that perhaps Redmond believes it has resolved such problems.

Microsoft’s own software already has considerable overlap with Skype. Windows Live Messenger offers free instant messaging, and voice- and video-chat. It currently boasts around 330 million active users each month, typically with around 40 million online at any one moment. Microsoft has an equivalent corporate-oriented system, Lync 2010 (formerly Office Communication Server) that allows companies to create private networks that combine the communications capabilities of Live Messenger with corporate manageability. The underlying technology of both platforms is common, allowing interoperability between Live Messenger and Lync. The company also plans to integrate Kinect into Lync to create more natural virtual presences.

Skype, in contrast, has around a third the number of active users: 124 million each month. It also has fewer simultaneous online connections: typically 20-30 million. Its instant messaging and voice and video call features are broadly similar to those found in Windows Live Messenger, though arguably more refined.

Though the Skype user base is very much smaller than that of Windows Live Messenger, it does have one key difference: About 8 million Skype users pay for the service. Skype integrates telephone connectivity and is able to make both outbound and inbound phone calls, and while its online services are all free to use, these phone services cost money. Skype also has points of presence across the globe, making it easy to buy phone numbers in foreign markets to cheaply establish an international telepresence.

Skype certainly has some things of value. The telephony infrastructure would make a valuable addition to the Messenger/Lync platform. It could also tie in well with Exchange 2010, which offers voicemail integration. Adding telephony to Lync, Exchange, and Live Messenger is certainly a logical way to extend those products.

Perhaps more adventurous, integrating Skype-like functionality into Windows Phone would be something of a game-changer. Integrated multinational VoIP support would potentially be enormously disruptive to the cellphone market. However, as good as this might be to end-users, it would probably serve only to kill Windows Phone stone dead for carriers.

As much as telephony integration into Microsoft’s communications products and VoIP integration into its telephony product makes sense, it’s hard to make sense of the deal. The purchase price is a phenomenal amount of money to spend on a company that has long struggled for profitability, and it’s hard to believe that it’s truly the most cost-effective way of getting access to telephony and VoIP technology. Microsoft could build equivalent telephony infrastructure for much less, just as Google is doing for Google Voice.

Similarly, although Skype is in many ways a better instant messaging and voice- or video-calling client than Live Messenger, it’s hard to believe that it’s $7 billion better. The Skype client itself is written almost as if it were a piece of malware, using complex obfuscation and anti-reverse engineering techniques, and it would be disquieting for Microsoft to release something that behaved in such a shady way; at the very least, the client would surely have to be rewritten to avoid the obfuscation and outright hostility to managed networks that Skype currently has.

Even the access to paying customers is hard to justify. The terms of the deal mean that for each Skype customer, Microsoft is paying about $1,000. And on average, those customers are worth a profit of about $30, presuming most of Skype’s income comes from subscriptions and call charges. That’s a huge disparity.

Windows Live Messenger users have shown no propensity towards paying money, unlike Skype’s 8 million paying users, and it may be a challenge to convert them from nonpaying to paying. However, since at the moment they have essentially nothing to pay for, it’s difficult to use that as evidence that they wouldn’t pay if there were services worth paying for. Especially as there’s likely to be quite a bit of overlap between the customer bases: People aren’t giving Skype the money instead of Microsoft because they prefer paying Skype, they’re doing it because Microsoft simply doesn’t sell Skype-like telephony facilities. And Lync customers are already on the payment treadmill, so it should be far easier to extract further payments from them for additional services.

Ultimately, it’s hard to see how the Skype purchase is worthwhile from a technology or user-access perspective. The technology isn’t good enough and the users aren’t lucrative enough or plentiful enough to justify it. But that doesn’t mean it won’t happen — and the prospect of keeping the company out of reach of Google and Facebook may just make the purchase irresistible.

The White House has named Jesse Lee to a new position within its communications department titled Director of Progressive Media & Online Response. According to The Huffington Post, Lee will essentially be responsible for building up Obama’s online presence as he prepares for his reelection bid, and squashing any negative stories:

The post is a new one for this White House. Rapid response has usually been outsourced to the Democratic National Committee (DNC), if not done on an ad-hoc basis by administration officials. And it signals that the White House will be adopting a more aggressive defense of the president and his policies as his re-election campaign gears up.

If you’re going to post something online about Obama that isn’t true, Lee is going to be the one to handle you. Considering that Lee’s first tweet about his new position included a picture of The Terminator, we suggest you watch what you say OR BE DESTROYED.
