4. Officers of the DfES shall have access at all reasonable times to the site (by prior agreement with the contractor) and to the individual at 1(l) above.

HOWEVER, individual 1(l) above, is this:

In particular DfES approval is required at the points outlined at (a) to (k) below.

But not the individaul at (1)l.

(l) has been excluded from the list. So Dfes shall make a prior agreement with a contractor, and an individual who does NOT have Dfes approval, before he accesses the construction site.
