A new police investigation has cast up memories for Angus Young of a visit to Hull by controversial former MP Harvey Proctor, and an intriguing court case in Beverley.
The sight of former Tory MP Harvey Proctor on the television news last week denying being part of a Westminster rent boy ring took me back a few years.
He delivered his statement after police from Operation Midland, who are investigating claims of historical child abuse, searched his home on the Belvoir Castle estate in Leicestershire.
I first encountered him in 1987, when he visited the University of Hull to speak to Conservative students.
At the time, the Scarborough-born politician's extreme views on immigration and repatriation were triggering protests whenever he appeared at speaking engagements across the country.
And Hull was no different, as students swarmed around his chauffeur-driven car when it arrived at the campus. Proctor was jostled after getting out, but his driver panicked and reversed the car into the crowd, injuring several protesters.
The incident caused a big stir at the time, prompting a review of security arrangements at the campus but I can't recall any charges ever being brought.
A few months later, Proctor's name cropped up again during a trial I was covering at Beverley Crown Court.
The defendant in the case was a chap called Terry Dwyer, who was in the dock for allowing cannabis to be smoked in a dodgy club he ran in Coltman Street, west Hull, until a police raid shut the place down.
The Lord Fox was an illegal drinking den, complete with massage facilities and a sling room where punters could be strung up from a metal frame chained to a wall.
Outside the court, Dwyer was a chatterbox.
He not only agreed to give me a guided tour of the club where he offered to sell me a giant wooden sauna housed in a first-floor room, but he also happily boasted about his time in London supplying rent boys to Harvey Proctor.
Two months earlier, the MP had pleaded guilty to four acts of gross indecency with two rent boys, who were aged 17 and 20 at the time.
He was fined �1,450 and subsequently resigned as the MP for Billericay.
I always wondered what happened to Dwyer, who was jailed for 12 months after being found guilty on the cannabis charge.
He was from London and his sudden arrival in Hull was always a bit of a mystery.
Perhaps Operation Midland will eventually provide a few answers.
SENIOR Tory politicians including Michael Heseltine, President of the Board of Trade, and Lord Archer have invested more than pounds 100,000 in a loss-making shirt shop owned by the disgraced former Tory MP, Harvey Proctor, perusal of the register of members' interests reveals to the curious inquirer.
The register discloses the fascinating fact that no fewer than 11 current MPs have shareholdings in a little-known clothes retailer, Cottonrose Ltd.
This turns out to be the company behind a quaint shirt shop nestling in a Georgian alley in Richmond upon Thames, one of London's most elegant suburbs.
Its name is Proctor's, and inside, among the bright cotton shirts, silk ties and gaudy waistcoats, is one of the more colourful figures of the Tory party's recent past, Harvey Proctor, who was forced to resign as MP for Billericay in 1987 after being fined pounds 1,450 for acts of gross indecency; he was involved in homosexual spanking sessions with young male prostitutes.
Mr Proctor turned from politics to hosiery and opened his shop in Brewers Lane, off Richmond Green, in 1988 with a pounds 2,000 grant from the Government's Enterprise Allowance Scheme, and a little help from his friends: a start-up fund of pounds 75,000 was organised by Tristan Garel-Jones MP, the former Tory deputy chief whip and one of the party's best-known fixers.
Lots of former chums chipped in. Besides multimillionaires such as Lord Archer and Mr Heseltine, they included the present Paymaster-General, David Heathcote-Amory; Mark Lennox-Boyd, a former junior Foreign Office minister; and MPs Sir Nicholas Bonsor (Upminster), Richard Shepherd (Aldridge-Brownhills) and David Evans (Welwyn Hatfield).
Several MPs who, like Mr Proctor, have suffered public reverses to their political careers also coughed up at least pounds 5,000 each. They included Neil Hamilton, forced to resign as Northern Ireland minister last week after allegations that he was rewarded by Mohamed Al Fayed, owner of Harrods, for helping in his battle with Tiny Rowland; Tim Yeo, the former Environment minister who was forced to resign after news broke of his adultery with Julia Stent, a Hackney Labour councillor, who bore his child; Michael Brown, who resigned as a Tory whip last May after a tabloid newspaper reported his homosexual affairs with a youth and a Ministry of Defence civil servant; and David Ashby, who suffered unwelcome publicity after admitting sleeping with a man but denying having sexual relations with him.
Then there were former MPs who, like Mr Proctor, have lost their seats: they include Sir Neil Thorne, William Benyon and Sir Charles Morrisson. All invested in Cottonrose. All have not done well. For business has not gone smoothly with the company: in the four years to March 1992 it made losses totalling pounds 109,421. Last year Mr Proctor failed to submit accounts for 1993, in breach of the Companies Act.
Asked about it yesterday, amid the gold cufflinks and Tino Cosma accessories, the silks and the satins, Mr Proctor's response was more of the sackcloth variety. 'I don't talk to lying newspapers,' he said. 'That is my quote. If you don't leave my shop I shall call the police.'
Mr Proctor, who invested pounds 20,000 of his own money, opened in a fanfare of publicity. He opened a second shop in Knightsbridge and, for a while, appeared to have a success on his hands. He was elected to the local chamber of commerce. John Major ditched his Marks & Spencer shirts in favour of Mr Proctor's more elegant wares.
But from the outset the project was a flop. In its first financial year to March 1989 it lost pounds 5,311. Further cash injections were put into the firm by the Tory MPs and other investors in 1990 and 1991. A share issue in 1990 produced an extra pounds 14,000.
In 1991 the investors ploughed in another pounds 10,000. MP Neil Hamilton's wife, Christine, bought pounds 500-worth of shares. The extra cash injections were to no avail. Losses in 1990, the second trading year, totalled pounds 26,547; in 1991 they climbed to pounds 46,066; and accounts for 1992 showed a loss of pounds 31,497. The position since is not known: Mr Proctor has yet to file accounts for 1993. Under Section 240 of the Companies Act he is obliged to file them within 10 months of the end of the financial year. They should have been lodged at Companies House by last January.
Last night MPs had resigned themselves to losing their investment. Sir Nicholas Bonsor said he feared he would not see his pounds 5,000 again. 'It was suggested we ought to rally round because he was clearly in great difficulty. We did make an effort at one stage; I had a meeting with other MPs and Harvey Proctor and, I think it was, his brother who was working in it with him. But then it looked as if it wasn't going to work so I think from that stage we wrote the investment off.'
Mr Heathcote-Amory said: 'Well, if I got the money back I'd be pleased - I'd rather written it off actually. It (the investment) was a gesture to help him (Mr Proctor). I felt a bit sorry for him. I haven't seen any accounts for a bit. That is not a complaint, but I'd rather lost interest in the thing. I think I'm braced to lose my equity.'
At least five of the Tory investors are MPs who have also suffered heavy losses on Lloyd's insurance syndicates.

I am very troubled by the treatment of former Tory MP Harvey Proctor at the hands of the Metropolitan Police’s Operation Midland inquiry. In some ways it mirrors that of Paul Gambaccini’s terrible year at the mercy of Operation Yewtree. I’m publishing his story in September and parts of it make your hair stand on end. I got wind that Harvey Proctor was holding a press conference on Tuesday and secured an exclusive radio interview with him. I knew it would be a difficult balance to strike. Although I had sympathy for his position I had to do a rigorous interview and ask some difficult questions. Judge for yourself if that was what actually happened in the blogpost below this one.
Proctor’s contention is that his accuser, “Nick”, is an obvious fantasist, and when he outlined some of the things he was accused of, it was difficult to draw any other conclusion. The most lurid was that Proctor was about to cut off a boy’s testicles with a penknife, when Edward Heath intervened to stop him. Somehow “Nick” was given that penknife and has now given it to the police. On the face of it, totally preposterous. Given that Proctor and Heath were sworn enemies is it even likely they would be in the same room together? I doubt it.
However, my colleagues at LBC have had dealings with “Nick”, and like the police, they regard him as credible. In some ways I don’t know what to think, but with all this publicity and the fact that “Nick” alleges there were many other boys involved, it’s odd, isn’t it, that no more have come forward? I believe there was abuse by politicians of young children in the 1970s and 1980s. I also believe that the police have a duty to investigate credible claims, especially when some of those accused are still alive. What they don’t have a right to do, though, is to act in the way they have in the Proctor case. Or the Cliff Richard case. Or the Gambaccini case. Or the Heath case.
Harvey Proctor was understandably very angry at the way he has been treated and angry in the way that his name has emerged in public. In some ways he is an easy target for any potential accuser, as a quick search of Google will uncover the fact that he pleaded guilty to four charges of gross indecency in 1987. He had sex with a 19 year old when the age of consent was 21, something which of course would not be a crime nowadays. He believed the individual to be over 21. Had it been a woman, that would be a credible defence but there was a so-called lacuna in the law and because it involved two men, that was no defence. As soon as he found that out, he pleaded guilty. He’s spent the last 28 years in private life but now it’s all over the media again.
If any living politician has committed any of these terrible crimes I hope they are brought to justice. If it turns out other politicians, including Margaret Thatcher, knew about any of this and deliberately covered it up, that needs to be exposed too. It would be very uncomfortable for many people to learn that some of their political heroes were effectively complicit in covering up these heinous crimes, but the truth must out.
But the police also need to answer for the way they are conducting some of these inquiries and enabling the public to adopt the belief that where there is smoke there must be fire. As a society we have reached a stage where whenever any famous person is mentioned in connection to child abuse, there appears to be an automatic assumption that they must therefore be guilty of something. This is a very dangerous development and it is why some people believe that the police are complicit in a media driven witch hunt against people who are often totally innocent. Their defence is that they need to shake the tree to see what fruit drops down. In some cases that may be a legitimate way of encouraging victims to come forward, but to me that should only ever happen when the police have proved to a judge there is a need to take that course of action. Otherwise, names should only come into the public sphere when they are charged.
Harvey Proctor hasn’t been arrested, let alone charged, yet his life has been ruined because the police gave his name to “Nick” who in turn passed it to the media. Proctor has been questioned about his alleged part in three murders, yet no charge has been forthcoming. Where this murky story goes next is anyone’s guess.
Ex-MP Harvey Proctor refuses to give evidence to Operation Midland review
Former MP Harvey Proctor has refused to give evidence to a review of Scotland Yard's handling of historical sex abuse probes, which he claims will be "a whitewash".
The 69-year-old declined an invitation to meet the former High Court judge leading the inquiry on May 12, because he alleges that the investigation will not be independent.
In a letter to Louise Oakley, a lawyer assisting Sir Richard Henriques with the probe, Mr Proctor said: "You are participating in a secret inquiry which is a cover-up and destined to become a 'brilliant' whitewash."
The ex-Tory politician, who represented Basildon from 1979 to 1983 and Billericay from 1983 to 1987, saw his home raided and was twice interviewed under caution as part of a doomed Scotland Yard investigation into claims of a Westminster paedophile ring.
He furiously denied any involvement and was finally told in March that he would face no further action.
The £1.8 million, 16-month Operation Midland, which looked at claims that boys were sexually abused by a number of public figures more than 30 years ago, ended earlier this year without a single arrest.
Mr Proctor has refused to meet Sir Richard, partly because the retired judge wrote a separate, damning report for the Crown Prosecution Service on missed chances to prosecute the late Lord Janner, who was also investigated as part of Operation Midland.
According to The Sunday Times, Lord Janner's family are also refusing to co-operate with the Henriques review.
Metropolitan Police Commissioner Sir Bernard Hogan-Howe announced in February that he had called in Sir Richard to examine a number of investigations involving non-recent abuse claims against public figures.
It came amid fierce criticism of Operation Midland, which saw raids on the homes of 92-year-old D-Day veteran Lord Bramall and the late Lord Brittan.
Scotland Yard will only publish parts of Sir Richard's final report, but a full copy will be given to the Goddard Inquiry into child sexual abuse.
Mr Proctor said he will also decline to give evidence to the public inquiry, and is willing to face prison or a fine if he is compelled to do so.
He said: "She (Dame Lowell Goddard) will have to fine or imprison me because there is no way I'm appearing before her. Her inquiry is biased and it's pro-victim and survivors. The assumption is that it was all credible and true."
In April Justice Goddard made a statement defending the inquiry, saying: "All of our investigations will be approached with diligence and with objectivity. In every single instance, I will ensure the inquiry examines all of the issues fairly and impartially.
"I am committed to ensuring that we hear all relevant testimony, including from victims and survivors as well as from those affected by false allegations of abuse."
“Credible and true” is how the police described the evidence against former Tory MP Harvey Proctor. He had been taken in and questioned under the aegis of ‘Operation Midland’ – Scotland Yard’s investigation into allegations of a historic Westminster paedophile ring which serviced the needs of gay politicians throughout the 1970s and 80s, and then apparently kept their sordid assignations secret by murdering some of the boys who did the servicing. To be accused of being a serial child-murder and of the sexual abuse of children is a serious thing. You would expect the police to act on such an allegation, especially if they judged the evidence to be not only sufficiently credible to pass the file to the CPS, but true enough to secure a conviction.
But the investigation was halted, and the case against Harvey Proctor has been dropped. Having trashed the man’s name and splashed it about all over the media on the strength of one solitary, anonymous and uncorroborated allegation from decades ago, the Met told Harvey Proctor that he was no longer a suspected serial child-murderer and paedophile, and that everything was now just fine and dandy, thank you very much. The evidence that was once deemed to be both credible and true is now seemingly neither.
Harvey Proctor’s accuser was a man called ‘Nick’ (his real identity has not been disclosed). As a result of these allegations, Harvey Proctor has lost his livelihood and home. “I have been pilloried and the Metropolitan Police Service has enabled and allowed me to be wrongly depicted as a paedophile, child abuser and child murderer on the back of a liar,” he said. “Nothing the police do or say, no weasel words of regret, can remove that indelible stain. I hope they are proud of themselves for irreparably ruining my life.” Whatever he now does; however he proceeds; whichever way he turns, Harvey Proctor’s name will be forever associated with the whiff of paedophilia.
Credible and true is also how the Church of England found the evidence against Bishop George Bell, who has not been questioned because he is dead. Their investigation was “thorough” and “objective”, not least because they commissioned “experts” whose “independent reports” (ie credible) found “no reason to doubt the veracity of the claim(s)” against him (ie it was true). Bishop George Bell is also accused of historic paedophilia (in the 1940s and 50s), and this, again, is a serious thing – especially for a prince of the Church and a shepherd of the sheep. So you would expect the Church of England to act on such an allegation, especially if they judged the evidence to be not only sufficiently credible to pay the victim compensation in a civil case, but true enough to trash the man’s sainted reputation by causing his name to be expunged from buildings named in his honour.
George Bell’s accuser is a woman called ‘Carol’ (her real identity has not been disclosed), who has written about her treatment. The release of this primary testimony has not persuaded the Church of England to make public the “independent reports” they commissioned to secure their judgment. So, on the strength of one solitary, anonymous, uncorroborated allegation from decades ago, in a secret post mortem hearing at which the Bishop was afforded no defence, the Church of England deemed the evidence against George Bell to be both credible and true.
“But someone came forward who said that they had been abused by him,” explained the Archbishop of Canterbury, Justin Welby. “And on the balance of probability at this distance it seemed clear to us, after very thorough investigation, that that was correct, and so we paid compensation and gave a profound and deeply-felt apology.”
“Nobody should imagine for one moment that any of us felt that George Bell could just be discarded. I mean he’s the greatest hero most of us have, and this has been an appalling shock and a terrible event to have had to deal with,” the Archbishop added. “But you have to listen to the survivors, you have to listen to those who’ve suffered and whose whole lives have often been destroyed and ruined by this.”
Except, of course, that “discarded” is precisely what George Bell has been. The evidence of his grave sin was judged to be both credible and true: “On the balance of probability at this distance it seemed clear to us,” the Archbishop of Canterbury insisted.
Issues of truth ought rightly to outweigh the bubble reputation. But truth demands justice, and justice must be seen to be done. The George Bell Group has determined that justice has not only not been seen to be done in this case; it has not been done at all:
We have concluded that on moral, pastoral and legal grounds the authorities of the Church of England clearly owe an apology, principally to the living relatives of Bishop Bell, and also to many people across the churches who have honoured his memory. We further invite all public institutions which have owned an association with the name of Bishop Bell to restore his name to the places where it was known and valued before 22 October 2015.
Might Carol be mistaken? Not at all, according to the experts who compiled their independent reports. Her recollection of events from the 1940s and 50s are engraved on her soul. Sexual abuse would be: there is scarcely a darker horror in the loss of innocence. ‘Carol’ has, however, issued an apology to former Archbishop of Canterbury Lord Carey, whose reputation she impugned by insisting that she had written to him to complain about the abuse she suffered. She said that she wrote to him 14 years ago. Except he wasn’t Archbishop of Canterbury in 2002. Wrong archbishop, you see. An honest mistake to make.
At least Harvey Proctor is alive and can write a book called Credible and True to set the record straight. Who can interrogate the credibility and truth of the Church of England’s evidence against Bishop George Bell when they refuse to disclose it?

The man, now in his forties, met the princess when he was sleeping rough outside a London church.
He claims he was subjected to horrific abuse at the Elm from the age of 10 while he was in care at Grafton Close children’s home.
Diana gave him food and helped him find a temporary home as he battled to rebuild his life in his twenties after escaping care.
He left a tribute to Diana at Kensington Palace when she died in the Paris car crash of 1997.

He said Joseph, Boyson, Dr Alastair Smith and Thatcher’s Attorney General Michael Havers attended them.
At least two alleged witnesses have also named former Tory MP Proctor, 67, as being at parties in statements for the inquiry.
He was exposed in 1986 for arranging sordid spanking sessions with young men and was found to be leading a double life and living with an 18-year-old male prostitute at a time when the legal age of consent was 21.
A court later heard how the pair had a bust-up when the relationship ended.
A source close to the inquiry told the Sunday Mirror: “Proctor’s name has repeatedly been mentioned by at least two alleged victims. He is going to be of key interest.”

Two senior ministers in the Thatcher government exposed by the Sunday Mirror last week for indulging in sex parties with underage rent boys were named in a damning paedophile dossier compiled in the 1980s.
Sir Keith Joseph and Sir Rhodes Boyson were cited in the “VIP” paedophile document drawn up by Labour’s Barbara Castle. Other MPs, senior policemen, head teachers and clergy were also named.
And today we can also reveal disgraced former Tory MP Harvey Proctor has been named by witnesses in connection with sex parties and faces being questioned by a Government inquiry.
Special branch officers seized Baroness Castle’s file in 1984.
Boyson was described in it as secretly involved with the notorious Paedophile Information Exchange (PIE) group which campaigned to legalise sex with children.
The dossier contained details of how the one-time Under Secretary for Education raised funds and drove promotions for PIE.
It was also claimed he arranged for members to meet influential education figures and even distributed their magazine MagPIE.
Joseph, tipped as a future Tory PM and later made a peer, also featured in Baroness Castle’s dossier several times.

As a Tory MP in the 1980s Harvey Proctor had a special talent. Some MPs courted attention through their colourful personal lives. Others with their extremist political views. Harvey Proctor found controversy in both.
In an age before politicians were out of the closet – and when the age of consent for homosexual sex was 21 – it was an open secret in Westminster that the impeccably turned-out Proctor was gay.
But his political downfall in 1987 – accompanied by newspaper headlines of teenage rent boys and spanking parties – was one of the most dramatic scandals in recent memory as he pleaded guilty to charges of gross indecency after repeated public denials that he had done anything wrong.

As for his politics, his views on immigration were considered so far beyond the pale that while serving as an MP he was beaten unconscious at a demonstration in Scarborough, had red paint thrown over him when addressing Coventry University, and burning papers were thrust through the letter box of his tiny terrace home in Billericay.

He shared the house with his feisty mother Hilda. ‘I’m the only woman in his life,’ she once told reporters.
It wasn’t quite true. There was also Margaret Thatcher. Proctor, who became MP for Basildon in the 1979 general election which swept Mrs Thatcher to power, was a lifelong fan of the Iron Lady.

But within weeks of being elected he was irritating her and the Tory high command with his strident views on migration, backing a motion calling for a ban on immigration from Commonwealth countries.
Urging the abolition of the Commission for Racial Equality, he demanded the forcible repatriation of 50,000 ‘coloured’ immigrants a year, proposing a £7,000 payment to encourage them to go.
He was also one of seven Tory MPs who rebelled against legislation allowing parents to exempt their children from corporal punishment in schools.
And he attempted to halt the growing tide of political correctness by launching a campaign to save the golliwog.
Born and brought up in Scarborough where he went to the local grammar, Scarborough High School for Boys, he eschewed his Christian name, Keith, and always went by his second name, Harvey.
He studied history at the University of York, where he had his first of many brushes with notoriety.
As chairman of the university Conservative association he invited Enoch Powell, who had been sacked from the Conservative shadow cabinet after his ‘rivers of blood’ speech on immigration, to make a keynote address.
There was a predictable uproar and the meeting became a riot. It was a sign of things to come – whenever Proctor addressed a university as an MP he was the subject of angry and often violent protests.
After university he worked for the Conservative Party research department in Old Queen Street near the Houses of Parliament. By the time he became MP for Basildon in 1979, he was already a darling of the Tory Right as a leading figure in the notorious Monday Club, a lobby group for the Conservatives but considered so extreme that in 2001 the party severed all links with it.
The group advocated voluntary or assisted repatriation for non-white immigrants, capital punishment, and denounced Nelson Mandela as a criminal and terrorist who deserved to be locked up.
Tall and gangly – he was once described in the Commons as a loping greyhound – the softly spoken Proctor revelled in the notoriety of being one of the most outspoken voices on the Tory backbenches.

When Labour-controlled Basildon council passed a motion of no confidence in him as the local MP because of his views on race, he was delighted.
After the re-drawing of political boundaries jeopardised his majority in Basildon, he was selected for the safe neighbouring seat of Billericay, which he won convincingly at the 1983 election. Proctor was loved by his local party because of his uncompromising views.
He called for the suspension of grants to students if they lacked self-discipline and for administrative and other non-academic parts of universities to be sold to the private sector.
His devoted Tory followers in Basildon and Billericay were oblivious to his homosexuality. While he was out with political friends he never discussed his private life. ‘It’s not relevant to my work as an MP,’ was his stock reply.
Fiercely ambitious, Proctor was consistently overlooked for ministerial preferment by Mrs Thatcher because of views on immigration which even some Tories viewed as racist. The Whips, in charge of party discipline, also feared his sexuality would be an issue that would return to haunt them. They were right.
The first story to emerge in public about it was in 1981, when Terry Woods, a flamboyant art dealer who was his boyfriend, had left the MP’s London flat after a row and Proctor refused to let him back in. The fracas led to a court appearance in which Woods claimed he was in a relationship – albeit it a very tempestuous one – with the MP. Proctor repudiated the claim and got away with it.
Lurid allegations surfaced in a Sunday newspaper in September 1986 claiming he had organised gay spanking sessions with canes and teenage rent boys in his flat – allegations he dismissed as monstrous.

He was embarrassed again soon afterwards when Woods, who remained his long-term lover, was found in his underpants by the police outside the MP’s apartment. He admitted that he ‘loved’ Proctor but insisted the relationship was not sexual.
Days later a story emerged of how a naked Arab boy had been found under Proctor’s hotel bed on a Tunisian holiday.
When police eventually charged him over the teenage rent boys in his flat, Proctor bowed to the inevitable and announced he was standing down as an MP, admitting to a charge of gross indecency and accepting a fine of £1,450.
Proctor was ruined. He had to sell his house in the constituency and the flat in London and was on the dole for a year.
But with the help of a £2,000 government grant and friends – including Jeffrey Archer, Michael Heseltine and other MPs who between them raised £75,000 on his behalf – he turned from politics to hosiery, opening a shop, Proctor’s, in Richmond selling shirts, gaudy waistcoats, silk ties, and natty cuff links.
Infamously, he hung a sign in the shop window saying: ‘Shirt lifters will not be prosecuted.’ Initially business seemed to be flourishing – John Major, when he became Prime Minister, ditched his Marks & Spencer shirts in favour of Proctor’s more elegant wares – and he opened a second shop in Knightsbridge.
But he could never escape his past. One day in 1992, two men walked into the Richmond shop. One of them demanded: ‘Have you any boys for tying up before you spank them,’ and then the men started punching him.

Proctor’s friend Neil Hamilton, then a government minister and in the shop at the time, came to Proctor’s aide and received a broken nose for his pains.
From then on, the shops went into decline. They were forced into liquidation in 2000 and Proctor disappeared beneath the radar only to re-emerge in 2004 at the Duke of Rutland’s ancestral seat, the gothic Belvoir Castle, where he is the events manager.

Keith Harvey Proctor seems to have spent most of his life walking under ladders, being in the wrong place at the wrong time, having black cats regularly walk across his path and spotting too many lone magpies. He is UNLUCKY to say the least. He claims that the world is out to get him, that he is targeted by the Metropolitan Police because some of them are homophobic and his convictions don’t count because they wouldn’t be convictions now. He is an honest man, guv. On the other hand, he has been accused of being a compulsive liar – a serial fantasist – a Walter Mitty type.

Before anyone concludes that my motives for collating this information is because I am homophobic or some sort of prude, I can assure you I am not. The reason I am highlighting this particular issue is that from listening to survivors of abuse and/or homelessness, I believe that many of these so-called “rent boys” (I hate using that term) were simply desperate youngsters who were exploited because of circumstance. Many were runaways from home or the care system, some thrown out of the care system at 16 with no means to support themselves, others still within the care system and simply exploited by those paid to ‘care’ for them, and then there were those who lived on very poor estates and were groomed. For many, the minute they reached a mainline London station they were pounced upon by unscrupulous men who saw a commodity in their flesh – Operation Circus and the ‘meat rack’ illustrates this as does the testimony of some involved in Proctor’s case. Some of these men had suffered the same fate highlighting a vicious circle of exploitation. It’s no different to what we have recently read about in Rotherham. I believe Proctor could have enjoyed his sexual proclivities meeting consenting like-minded men but he chose to finance those who exploited youngsters instead. It’s also important to remember that from the testimonies of some involved, many of the youngsters involved weren’t expecting his level of sadistic “pleasure” and unless it’s consenting, it’s not OK. He abused his position, he financed the machine and then he finished with the ultimate humiliation of photographing them.

Two police investigations gathered evidence that former Conservative MP Harvey Proctor had a sexual interest in children, Newcastle crown court heard.
One witness told the first police investigation, of 1986-7, that Proctor sexually abused him as a 14-year-old boy, while other witnesses told detectives that the then MP beat “young men or boys” and took photographs of their injuries, according to submissions to the court. One described a request for the procurement of “young things”.
Another of these witnesses, the court heard, told the police investigation that he discovered a big envelope of pictures of boys aged 11-19, “including lots of kids about 11-12 years old”. But no police action was taken on any of the claims.
The court was hearing legal submissions during the trial of ‘Nick’, Carl Beech, the man convicted yesterday of 12 charges of seeking to pervert the course of justice and one of fraud when making claims of sexual abuse by VIPs. I was the only journalist to cover the trial consistently, day by day, on Twitter @MarkWatts_1.
Sir James Goss, the High Court judge who oversaw the ‘Nick’ trial, blocked defence attempts to admit the evidence on the grounds of insufficient relevance. But the hearing on June 21, held in the absence of the jury, could only be reported following its verdicts.
And it raises questions as to whether the Metropolitan Police Service disclosed any of the material to the inquiry into child sexual abuse chaired by Alexis Jay. And, if so, why the inquiry has so far chosen to ignore the evidence.
Collingwood Thompson, barrister for Carl Beech, made an application for more disclosure to the defence and for permission to cross-examine Proctor on specific issues. He made the application to the judge the day after the prosecution finished direct examination of Proctor and ahead of his cross-examination.
He said that he was basing his application on material disclosed by the prosecution to the defence only “very recently”.
He raised material gathered, first, by the police investigation before Proctor pleaded guilty in 1987 to three counts of gross indecency with a 17-year-old man and a fourth count with a man aged 20 at a time when the age of consent was 21 and, second, by ‘Operation Midland’ that was sparked by allegations from ‘Nick’ in 2014.
At the hearing, the judge largely worked from written submissions by defence and prosecution counsel. But Thompson confirmed the judge’s understanding that the material from the first investigation related to “the circumstances of these offences… dressing as children, punishing them in a particularly… physically beating them to a stage where they were being marked.”
Thompson wanted the evidence admitted to the case because it went to Proctor’s “character”.
Beyond the two complainants in the 1987 case, he told the court, there were four other witnesses – referred to as witnesses 27, 7, 15 and 10 – who described their sexual activities with Proctor as young men or boys.
One of the complainants “alleged Harvey Proctor inflicted pain for pleasure,” said Thompson. “There is direct evidence of inflicting pain for the purpose of sexual pleasure,” adding, “A number of witness statements did appear to relate to these allegations.”
A 23-year-old said that Proctor “showed an interest in young boys,” Thompson told the court. “Someone who ran an escort agency [said]: ‘He seemed to be interested in young boys.’”
One of the witnesses knew Proctor as “Keith”, but the former MP also used the name, “David”, the court heard. A witness said that Proctor identified himself as an MP.
Thompson told the court: “These matters date from 1986, not so very long after the period we are looking at [in this trial].”
In his summary of Thompson’s submissions to the court, the judge records:
“The activities spoken of in the witness statements include paying for ‘rent boys’/escorts, asking them to dress as schoolboys in shorts, pretending to be a headmaster or school teacher and punishing them for wrong-doing by spanking or repeatedly beating them hard on their buttocks with his hand, slipper or plimsole and a cane, in many cases causing pain and leaving marks or wheals on their buttocks.
“In some cases, he took Polaroid photographs of the injuries inflicted. One witness says he discovered a big envelope containing Polaroid photos of boys aged 11-19 ‘including lots of kids about 11-12 years old’.
“On occasions he told boys to engage in sexual activity with each other and he could be involved with up to four boys at any one time. One witness described a request for the procurement of ‘young things’.
“Witness 15 states that, when aged 14, he was painfully ‘slippered’ before being made to engage in anal intercourse. The activities were for sexual gratification: he was said to masturbate himself and/or the ‘boys’. There was a range of penetrative sexual activities.”
“The defence wish to cross-examine Mr Proctor about each of these alleged activities. They point to the case against the defendant arising from allegations made by him that Mr Proctor engaged in sexual activity with young boys at around the time he is alleged to have committed the acts of which the defendant accuses him.
“They refer to the fact that there were occasions which involved more than one boy and in which boys were told to engage in sexual activity with one another, and there was a full range of sexual activity, including masturbation, oral intercourse and anal intercourse.
“There was a sadomasochistic element to such sexual activity: Mr Proctor engaged in sexual activity with boys who were made to dress and behave as if they were younger which involved inflicting some pain for the purpose of obtaining sexual pleasure. The defence wish to ask him about these aspects of the facts of, and said to be surrounding his previous convictions.”
The defence was making its application under section 100 of the Criminal Justice Act 2003.
Thompson went on to 2015, and the Met’s search of Proctor’s home under ‘Operation Midland’. He said that the prosecution had recently disclosed to the defence the schedule of items seized in the property search.
One of the allegations made by ‘Nick’ was that, Thompson told the court, “a victim was restrained on a table, tied to a table. One of the items here is, restraint, and another, straps.”
“Recovered a school uniform, with a child’s underwear… for a child of 13 to 14… blood stained… Harvey Proctor declined to give a blood sample.” Police had not arrested Proctor, so could only take a blood sample from him with his consent.
Thompson said: “This is someone who enjoys inflicting pain for sexual pleasure, which is one of the issues relating to him.”
The judge added that the list of seized items include “whip and the crop, restraints”.
Thompson said that seized items include whips, restraints and cane. He also referred to a “notepad relating to child abuse”, which was entitled, “Bizarre Sex”.
The defence had only seen a list of items recovered, and it wanted the judge to order the disclosure of, for example, this notepad.
Tony Badenoch, prosecuting counsel, intervened at this point to say that following the seizure by police of items in the property search, “All material was returned to Mr Proctor.” The prosecution could not disclose any of the material because the police no longer had it.
The judge added that the seized items included indecent photographs. He said that DC Danny Chatfield, who gave evidence earlier in the trial about ‘Operation Midland’ but not about this issue, formally seized the items on behalf of the Met and signed the appropriate form.
The judge added: “Perhaps we should have him tell us more about this.”
But Chatfield was not recalled.
Addressing Thompson, the judge said: “We are somewhat in the dark. You are in the dark, I am in the dark, and I’ve got to make a judgment.”
The judge summarised Thompson’s submissions on the list of seized items in these terms:
“The defence also want to question Mr Proctor about items on an ‘exhibit list’ referred to in a statement from DC Chatfield [DCJ] who was involved in the search of Mr Proctor’s home on 4th March 2015 and the descriptions of various items seized and since returned to him.
“Those items on the list about which they particularly wish to question him are (DCJ/21) a school uniform and children’s underwear (aged 13-14yrs) bloodstained, (DCJ/22) school blazer, (DCJ /23) schoolwear stained, (DCJ/24) whips/ruler with blood, (DCJ/25/3) whip/crop and (DCJ/26) restraint with leather straps.
"They submit that the possession of such items is ‘to do with the alleged facts of the offence with which the defendant is charged,’ and so judicial leave to cross examine upon such matters is not required. They argue that it is implicit in the Crown’s case that the defendant falsely accused Mr Proctor of sexually assaulting him and others in a way that involved the use of force and that the presence of such items at Mr Proctor’s home is capable of supporting the defendant’s case that he was someone with an interest in sadistic sex.”
Badenoch objected to the defence application, saying that there was a “real disconnect” between what Thompson was seeking to introduce and the charges against the defendant.
“They are a million miles away from what is alleged by Carl Beech.”
He told the court that the other matters, beyond the two complainants of 17 and 20, were not sufficiently serious for any prosecution to result.
The judge said that on those matters where Proctor had not pleaded guilty, “I am not concerned about.”
But the judge wondered out loud about the right approach in relation to the four offences to which Proctor had pleaded guilty, saying: “We have more details from these witness statements, so the issue is what facts around these circumstances have relevance.”
Badenoch insisted that they were a “million miles away” from the allegations in the trial.
The judge replied: “Well, there are differences, but there are- there is that nexus.”
He asked Badenoch for his response on the items found in the search.
Badenoch told the judge that he could see the author of the book in Chatfield’s statement. The indecent photographs “could be mild”, could be “perfectly legal”, the schedule did not specify. There was no prosecution, he said.
He repeated: “All the material was given back to him.”
In summarising Badenoch’s submissions to the court, the judge records:
“The prosecution submit that Mr Proctor’s convictions amount to no more than engaging in consensual sexual activity with two males who were then under the prevailing legal age of 21 (Witness 9 was aged 16/17 and Witness 12 was aged 20). They point to the surrounding circumstances of the accounts of Witnesses 9 and 12 not having been the subject of any criminal charge. In any event, they do not involve any allegation of unlawful, non-consensual violence, or sexual activity, rape or sexual activity involving young children. Moreover, it is to be noted that when objection was taken to any particular activity requested by Mr Procter, he accepted the witness’s wishes. The other allegations recorded during the 1986-1987 investigation (Witnesses 27, 7, 15 and 10) were not the subject of any criminal charge or conviction. They amount to unsubstantiated allegations.
“Further, the sole allegation of non-consensual sexual activity was with a young boy, Witness 15, who claimed to be 14 years old at the time of the alleged offence. However, that allegation resulted in no arrest, charge or conviction and the witness had provided an earlier statement in which he denied (by necessary implication) that he had ever met Harvey Proctor. It is, therefore, an unproven allegation from an unreliable witness, which is material to its weight.”
“The premises from which material was seized during the searches on 17 March 2015 were occupied by others, including a couple with a young child. All the property seized, including digital devices, was carefully examined. All the property was returned. Nothing illegal was recovered. No charges were brought.”
“The prosecution submit that the primary issue in the case is whether the defendant told the truth to the police when he made the detailed allegations of giving rise to the charges of perverting the course of justice. It follows that whether he told the truth in respect of his allegations against Mr Proctor is a matter of substantial importance in the context of the case as a whole. The allegations against Mr Proctor, in brief summary… are of multiple offences of rape, both oral and anal, on occasions jointly with other men, extreme physical violence, including torture and the threat of genital mutilation with a pen-knife, being part of a group responsible for killing one boy and himself murdering two boys, after having raped one of them.”
“The prosecution submit that the true ‘issue’, in the context of the defence application, is whether Mr Proctor has a propensity, as a member of a group, to (i) commit acts of serious unlawful violence against very young boys; (ii) commit acts of serious, non-consensual sexual assault against very young boys; (iii) murder; and (iv) rape. It is accepted that if there was reliable evidence in relation to these issues it would be of substantial importance in the context of the case as a whole.”
“However, they submit, there is no such evidence, let alone evidence which has a ‘substantial probative value’ in relation to those issues. Further, there is no probative evidence directed at the issues identified above at all. The prosecution led the evidence from Mr Proctor as to his four previous convictions by agreement and because they are relevant to the facts of the offences with which the defendant is accused, their case being that the defendant identified and deliberately chose Harvey Proctor as one his targets for false allegations because of his convictions in 1987 and the surrounding and resulting scandal, rumour and innuendo.
“They dispute that the ‘issues’ identified by the defendant are of substantial importance in the context of the case as a whole: they contend that whether or not Mr Proctor engaged male prostitutes, indulged in ‘corporal punishment’ schoolboy fantasies or was concerned to possess photographs of them, are not ‘issues’ of ‘substantial importance’ in the case.
“When focussing on the specific allegations made against Mr Proctor (and others) by the defendant, the ‘issues’ identified by the defendant are divorced from the true issues in the case, or are at the very least tangential to them. Further, they submit, the body of the evidence upon which the defendant asserts ‘goes to’ the issues identified lack the ‘substantial’ probative quality required for admission. Mr Proctor was convicted of four offences of gross indecency, for which he was fined. The body of evidence does not establish that he ever engaged in sexual activity with younger boys to the requisite standard, or at all.”
“The prosecution assert that the proposed cross-examination of Mr Proctor in relation to the 1987 material would inexorably lead to the litigation of ‘satellite’ issues in respect of which the Court of Appeal has repeatedly warned against, and the ‘kite-flying and innuendo against the character of a witness’ which the Court has observed section 100 of the 2003 Act was intended to guard against.”
“In relation to the evidence of items recovered from Mr Proctor’s property on 17 March 2015, the prosecution disputes that it/they has/have to do with the ‘alleged facts of the offence with which the defendant is charged’, and thereby escape the provisions of section 100 of the Act.
“They submit that if this category of evidence is capable of supporting the defendant’s case, it can only be so by way of being evidence of a propensity to act in the manner alleged, and so is ‘bad character’ evidence. The potentially relevant items were subjected to forensic scientific examination and yielded no results relevant to this case. All items were returned to Mr Proctor.
“In relation to evidence of a relevant propensity, the defence assert that the evidence is ‘capable of supporting [his] case that [Harvey Proctor] was someone with an interest in sadistic sex.’
“The prosecution say that this is not the defendant’s true case. At no stage has the defendant alleged sexual activity of the kind alleged in the offences of which Mr Proctor has been convicted. Alternatively, they submit, if it is the defendant’s case that Harvey Proctor ‘was someone with an interest in sadistic sex’, then this is not an issue of substantial probative value in the context of the case as a whole: the defendant’s case is that Mr Proctor is a violent rapist and murderer of young boys.”
The hearing started at 10.34am, and was adjourned exactly an hour later. The judge said as he adjourned that he would give his decision at midday.
At 12.01pm, the judge returned. He said: “I have re-read these witness statements and the application, its supplication by your submission made to me this morning.
“The application to cross-examine Harvey Proctor on the matter is refused, and the application to cross-examine about the items in paragraph 31 and the application to list the items seized and returned to Mr Proctor is also refused.”
In his written reasons, the judge said:
“For the reasons identified by the prosecution and summarised above, I am satisfied that the evidence the defence seek to introduce by way of cross-examination of Mr Proctor in relation to the search list is not evidence that has to do with the offences upon which is being tried [sic] nor, in any event, does any of it have substantial probative value in relation to a matter which is in issue in the proceedings and is of substantial importance in the context of the case as a whole.
“The issues in the case are those identified… [by the prosecution] above. The evidence of an interest in consensual sexual activity with young men, including the acting out of a fantasy of schoolboy punishment by a headmaster by beating is an interest and behaviour that is very far removed from the issues in this trial and has no substantial probative value in relation to any of them.
“The evidence of the witness in the 1987 case who alleged a non-consensual act was not pursued or adjudicated upon and the witness himself was demonstrably unreliable.”
“For these reasons the defence application is refused.”
Thompson then asked the judge whether he could cross-examine Proctor on his denials in relation to matters that later led to his guilty pleas.
The judge refused, saying that it was fraught with difficulty because Proctor’s denials would have depended on what questions had been asked of him exactly.
Thompson then cross-examined Proctor that afternoon, but was unable to raise any of these issues with him.
The defence team is understood to be seeking an appeal against Carl Beech’s convictions over this, and other, rulings by the trial judge, including his rejection of another disclosure application and his decision to allow the prosecution to tell the jury all about the defendant’s guilty pleas in January on five charges of downloading and possessing indecent images of children and one of voyeurism.

The seven-week trial earlier heard how Beech told detectives that his friend, Scott, was run over and killed by the paedophile gang in 1979 but police could find no trace of the incident.
Asked by Collingwood Thompson QC, defending, about the suggestion that his claim about the hit-and-run attack was a figment of his imagination, Beech replied: “I know what happened. I was there and I know it took place.â€
Beech became emotional as he told the court that Scott – whom he claimed to have met in a playground in Kingston-upon-Thames, south-west London – was run over as they walked away from school during the day.
“He was hit by a car,†Beech alleged, explaining that the pair were side-by-side on the pavement. “I just heard a loud noise behind me. It all sort of happened at the same time.â€
Beech said Scott “went over the front of the car into the roadâ€, adding: “His leg was bent in a funny direction. There was blood on his head.â€
Beech claimed he was dragged away into a car, adding: “I just remember something in my arm and I don’t remember anything after that.â€
The paedophile gang was responsible for the attack, Beech said, claiming that Hanley had warned him not to have friends shortly after he met Scott several months earlier. “I’m not sure I believed anything would happen. I ignored what he said,†he told the court.
Beech said he did not tell anyone about the incident afterwards, explaining: “I didn’t even say anything to my dog.â€
On another occasion, Beech told the court he was taken to a townhouse in London with another boy who he thought was “possibly†Martin Allen, the teenager who went missing in 1979.
He claimed Proctor and another man tied the boy to a table, with the politician stabbing the child in the arm and cutting his chest and legs before both men left the room.
Beech told the court: “I tried to untie him, but I couldn’t. There was a lot of blood, he just kept saying sorry.â€
When the men returned, Beech said, Proctor then raped the other boy. Asked by Thompson QC, what he was doing while that happened, Beech replied: “Begging for him to stop and he kept saying sorry, but they didn’t listen.â€
Beech said he held hands with the other child as they were both being raped, while the other boy was being strangled. Afterwards, Beech told the court, he “tried to wake him up but I couldn’tâ€.
At another abuse session at a London house allegedly attended by Brittan, Proctor, Hanley and other men, Beech claimed a boy was beaten until he stopped breathing.
Proctor has always vehemently denied all the accusations made by Beech. The trial continues.
